Terms & Conditions

Shipping

The Museums of History NSW online shop ships domestically only.

We ask that customers be mindful of the impact of public holidays, severe weather conditions and COVID-19 disruptions when placing their orders.

Shipping, taxes, and discounts will be calculated at checkout.

Please note that the Museums of History NSW shop does not ship to Australia Post Parcel Collect or P.O. Box addresses.

Click & Collect

The Museums of History NSW Shop now offers Click & Collect.

Simply select 'Pick up' at checkout when placing your order to arrange for your order as Click & Collect. 

Once you have been notified that your order is ready, collect your order from Bullion Store at The Mint between the hours of 11 am-3:30 pm, Monday-Friday, excluding public holidays. Click & Collect orders are usually ready for collection between 2-4 business days from orders being placed.

Please bring your order confirmation email with you when collecting your order as your proof of purchase.

Returns

Our returns policy which is described below does not limit or exclude the rights and remedies which are available to you when a product does not comply with a consumer guarantee.

Our returns policy for ‘change of mind’ purchases applies for 30 days from the date of purchase. If more than 30 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange.

To be eligible for a return under the 30-day return policy, your item must be unused and in the same condition that you received it. It must also be in the original packaging. Customers are responsible for the cost and risk of returning goods, including the cost of return shipping. 

Several types of goods are exempt from being returned. Perishable goods such as food, flowers, newspapers, or magazines cannot be returned. We also do not accept returns on products that are intimate or sanitary goods, hazardous materials, or flammable liquids or gases. Pierced jewellery also cannot be returned, unless found to be faulty.

Additional non-returnable items:

  • Gift cards
  • Downloadable software products
  • Some health and personal care items

To complete your return, we require a receipt or proof of purchase.

Please do not send your purchase back to the manufacturer.

There are certain situations where only partial refunds will be granted (if applicable):

  • the item is a book with obvious signs of use
  • the item is a CD, DVD, VHS tape, software, video game, cassette tape, or vinyl record that has been opened
  • the item not in its original condition, is damaged after receipt by you or missing parts for reasons not due to our error
  • the item is returned more than 30 days after delivery

Refunds (if applicable)

Once your return has been received and reviewed, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If your refund has been approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a few business days.

Late or missing refunds (if applicable)

If you have not received a refund yet, we ask that you do the following:

  1. first check your credit card account again;
  2. then contact your credit card company, as it may take some time before your refund is officially posted; and
  3. next contact your bank, as there is often some processing time before a refund is posted.

If you have done all of this and you still have not received your refund, please contact us at shop@mhnsw.au. 

Exchanges (if applicable)

We only replace items if they are defective or damaged, and if there is a replacement item available in stock. If you need to exchange your item for the same item, please send us an email at shop@mhnsw.au to determine if an exchange is an option for you. If we do not have a replacement item in stock, you may be eligible for a refund instead.

Please note that you will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable, unless we determine that the product does not meet the consumer guarantees, in which case we will reimburse you for your return shipping costs once we receive the item.

Depending on where you live, the time it may take for your exchanged product to reach you may vary.

If you are shipping an item over $75, you should consider using a trackable shipping service or purchasing shipping insurance. We cannot guarantee that we will receive your returned item. 

Customs, Duties and Taxes

The recipient of any goods purchased is the importer and therefore must comply with all laws and regulations of the destination country.

Please be aware orders shipped outside of Australia may be subject to import taxes, customs duties and fees charged by the destination country. If your order is to be delivered outside Australia, your purchase may be subject to these additional fees, which are levied once a shipment reaches the destination country. Museums of History NSW has no control over what is charged by destination countries and is therefore unable to provide any costs or estimates.

Additional charges for customs clearance are not the responsibility of Museums of History NSW and must be paid directly to the relevant customs or related office by the purchaser or recipient. To find out more, we recommend you contact the customs department of the destination country.

 PRIVACY POLICY

SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

When you browse our store, we automatically receive your computer’s internet protocol (IP) address. This gives us information about your browser and operating system.

When you purchase something from our store, we ask for certain personal information such as your name, address, and email address to facilitate the sale.

Email marketing (if applicable): With your permission, we may send you emails about our store, new products, and other updates. You can unsubscribe for email marketing at any time.

SECTION 2 - CONSENT 

How do you get my consent?

When you provide us with personal information to complete a transaction (including placing an order, arranging for delivery or returning a purchase) or verify your credit card, you give your implied consent to us collecting and using such information for that specific reason only.

If we ask for your personal information for a secondary reason such as marketing, we will obtain your express consent.

How do I withdraw my consent?

If, after you opt-in to any email marketing, you change your mind, you may withdraw your consent for us to contact you, and you may also withdraw your consent for the continued collection, use or disclosure of your information, at any time, by contacting us at shop@mhnsw.au or mailing us at:

SECTION 3 - DISCLOSURE

We may disclose your personal information if we are required by law to do so or if we suspect that your use of our site or services violates our Terms of Service set out below.

SECTION 4 - SHOPIFY

Our store is hosted on Shopify Inc. Shopify provides us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored in Shopify’s data storage, databases, and the general Shopify application. Shopify stores your data on a secure server behind a firewall.

Payment:

If you choose a direct payment gateway to complete your purchase, then Shopify will store your credit card data for as long as it is necessary to complete your purchase transaction. Your credit card data will be encrypted according to the Payment Card Industry Data Security Standard (PCI-DSS).  After your purchase transaction is complete, your purchase transaction information will be deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of organisations including Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 - THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use, and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect of the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

Certain providers may be located in or have facilities that are located a foreign jurisdiction. So, if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

For example, if you are located in Australia and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

When you click on links on our store’s website, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements. 

SECTION 6 - SECURITY

We take reasonable precautions and follow industry best practices to protect your personal information and to make sure such information is not lost, misused, inappropriately accessed, disclosed, altered, or destroyed, except in accordance with this privacy policy or any applicable laws.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with an AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

SECTION 7 - COOKIES

We set out below a list of cookies that we use on our store’s website. You can choose to opt-out of cookies at any time.

 _session_id, unique token, sessional, Allows Shopify to store information about your session (referrer, landing page, etc).

 _shopify_visit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider’s internal stats tracker to record the number of visits

 _shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer.

cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart.

 _secure_session_id, unique token, sessional

 storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.

  SECTION 8 - AGE OF CONSENT

 By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

 SECTION 9 - CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this privacy policy at any time, so please check for updates periodically. Changes and clarifications will take effect immediately upon publication on the website. By continuing to use our site you consent to any changes to this privacy policy.

If our store is acquired by or merged with another entity, your information may be transferred to the new owners.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store, however actual colours may vary. As  computer monitors have a different capabilities to display colours, we cannot guarantee that the display of any colour will be accurate. 
We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. 
We do not warrant that the quality of any products, services, information, or other materials purchased or obtained by you will meet your expectations, or that any errors in the service will be corrected.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable in a jurisdiction, the unenforceable portion shall be deemed to be severed from these Terms of Service in that jurisdiction, but such determination shall not affect the validity and enforceability of that provision in any other jurisdiction, or any other remaining provisions.

SECTION 17 - TERMINATION

We may, in our sole discretion, suspend or terminate your access to our site or services at any time without notice, and you will remain liable for all amounts due up to and including the date of suspension or termination. Suspension or termination shall not affect the obligations and liabilities of the parties incurred prior to the suspension or termination date.

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 19 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you with the services shall be governed by and construed in accordance with the laws of New South Wales. If a dispute arises in connection with these Terms, you agree to submit to the non-exclusive jurisdiction of the courts of that place.
